By accessing, browsing, or using ai Gene X™ (the "Service"), operated by ai Swing X™ ("Company", "we", "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must immediately discontinue use of the Service.

2. Description of Service

ai Gene X™ is an AI-powered platform that analyzes user-submitted genomic data files (VCF — Variant Call Format) to provide educational, exploratory, and informational insights into genetic traits, personality tendencies (Gene Types), and famous figure matches. The Service is not a medical, diagnostic, clinical, or therapeutic tool.

3. No Medical or Diagnostic Advice

The information provided by the Service is for general informational and educational purposes only. It does not constitute medical advice, diagnosis, prognosis, treatment recommendation, or genetic counseling. You should not rely on any output from this Service to make medical, health, lifestyle, reproductive, or legal decisions. Always consult a qualified healthcare professional or certified genetic counselor before acting on any information related to your genetic data.

4. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Service. If you are between 13 and 18, you may only use the Service with verifiable parental or guardian consent. We do not knowingly collect or process genetic data from anyone under 13 years of age.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

6. Genetic Data Handling

6.1 Upload: You represent and warrant that any VCF file you upload is your own genetic data, lawfully obtained from a legitimate testing service (e.g., 23andMe, AncestryDNA, MyHeritage), and that you have full legal authority to submit it for analysis.

6.2 Processing: Your VCF file is processed in an isolated, encrypted environment. Only essential variant information (SNP/rsID) is extracted for analysis.

6.3 Deletion: Raw VCF files are automatically and permanently deleted immediately after analysis is complete. We do not retain, archive, or back up raw genetic files.

6.4 Encrypted Storage: Extracted genotype data is encrypted using Fernet symmetric encryption before storage. Only your authenticated session can decrypt and display this data.

6.5 No Third-Party Sharing: Your genetic data is never sold, shared, licensed, or disclosed to any third party, including advertisers, researchers, insurance companies, employers, or government agencies, except as required by applicable law with valid legal process.

7. Accuracy and Limitations

While we strive for accuracy, the Service relies on publicly available genomic research, SNP databases (e.g., SNPedia), and AI algorithms that are inherently probabilistic. Results may be incomplete, imprecise, or subject to change as scientific understanding evolves. We make no warranties regarding the accuracy, completeness, or reliability of any output.

8. Gene Type Results

Gene Type classifications and famous figure matches are generated by algorithmic analysis of genetic variants. They are intended as exploratory and entertaining personality insights, not definitive scientific conclusions about your abilities, limitations, or destiny. They should not be used for employment decisions, educational placement, insurance assessment, or any form of discrimination.

9. User Conduct

You agree not to:

• Upload genetic data belonging to another person without their explicit written consent
• Attempt to reverse-engineer, decompile, or extract our algorithms or proprietary data
• Use the Service for unauthorized commercial, clinical, or research purposes
• Upload malicious files or attempt to compromise the platform's security
• Scrape, crawl, or automate access to the Service without written permission

10. Subscription and Payments

Certain features require a paid subscription processed through Stripe. All payments are handled securely by Stripe; we do not store credit card information. Subscription terms, pricing, and cancellation policies are displayed at the time of purchase. Refunds are handled on a case-by-case basis.

11. Intellectual Property

All content, algorithms, designs, trademarks, and proprietary technology within ai Gene X™ are owned by ai Swing X™ and protected under U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our explicit written consent.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ai Swing X™ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, HEALTH OUTCOMES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless ai Swing X™ from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

The Service may contain links to third-party websites (e.g., 23andMe, AncestryDNA, Stripe). We are not responsible for the content, privacy practices, or terms of any third-party service. Your interactions with third parties are solely between you and them.

16. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and all associated data at any time.

17. Changes to Terms

We may modify these Terms at any time by posting the updated version on this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

18. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You waive any objection to jurisdiction or venue in such courts.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ai Swing X™ regarding your use of the Service and supersede all prior agreements.
